Trump Says He Ordered Justice Department Lawsuit Targeting Alaska Senate Certification

President Donald Trump said Friday that he personally directed the Justice Department to file the Alaska Senate lawsuit seeking to block certification of the state’s Senate results should the Republican incumbent lose. The complaint landed 11 days before polls close on 3 November, an extraordinary federal move in a race that could decide control of the Senate.

What the complaint asks for

Filed on 23 October 2026, the lawsuit requests a pause in certification while an investigation proceeds. Its central claim is that voters could confuse two candidates named Dan Sullivan on the same ballot. The complaint asserts that the candidacy of Daniel J Sullivan, a retired schoolteacher from Petersburg running as a Republican, is intended to benefit the campaign of Democratic nominee Mary Peltola. It further alleges a substantial likelihood that certification would lack integrity absent review.

The investigation the administration seeks would examine whether ballots cast for Daniel J Sullivan were actually meant for the incumbent, Dan S Sullivan. The Justice Department grounded its argument in the preamble language of the 1993 National Voter Registration Act, which speaks to the integrity of the electoral process.

The two Dan Sullivans

Dan S Sullivan is the Republican incumbent senator seeking reelection. Daniel J Sullivan is a retired schoolteacher from Petersburg, a town of roughly 3,000 people, and is also running as a Republican. Trump and his allies have described Daniel J Sullivan as an impostor without offering evidence, and many Republicans accuse him of acting as a Democratic plant.

On the ballot, the incumbent’s label will read Registered Republican Incumbent, a distinction that supporters say makes the two candidates easy to tell apart.

Experts see a thin legal case

Legal scholars and election specialists were blunt about the complaint’s prospects. Derek Mueller, a law professor at the University of Notre Dame, called the legal claim absurdly thin and unlikely to succeed. David Becker, executive director of the Center for Election Innovation & Research, described the suit as an unprecedented federal intervention and said he could not recall any administration ever trying to stop certification. He also raised concerns about political interference, noting that the same-name ballot issue had already been fully litigated in Alaska courts.

Chris Shenton, a lawyer at the Southern Coalition for Social Justice, compared the legal reasoning to a frivolous constitutional claim. Experts also pointed out a practical obstacle: because voting is secret, investigating voter intent after the fact is essentially impossible.

Ranked-choice voting at the center

Alaska voters adopted ranked-choice voting in 2020. Under the system, the top four candidates from an open primary advance to the general election, where voters rank the contenders and votes transfer as lower-placed candidates are eliminated. Trump has repeatedly criticized the system as a scam and encouraged Alaskans to back a ballot measure repealing it during a rally in Wasilla on 13 October 2026.

Reactions from Peltola and Murkowski

Peltola, a former congresswoman and the Democratic nominee, called the lawsuit a distraction and corruption, describing it as a desperate attempt to cling to power. She said Alaskans know who they are voting for.

Senator Lisa Murkowski, a Republican who frequently breaks with her party, condemned the suit. She said Alaska already clearly distinguished the candidates on the ballot, that Alaskans do not need help voting, and that the Justice Department should never have filed the lawsuit.

Stakes and prior rulings

Polls suggest a dead heat between Dan S Sullivan and Peltola, and Democrats increasingly believe Peltola could flip the red-leaning state. A Peltola victory would make her the first Democrat to win the seat in nearly two decades. Republicans fear Daniel J Sullivan could siphon votes from the incumbent.

The Alaska Supreme Court ruled in June 2026 that Daniel J Sullivan could remain on the ballot, resolving the inclusion question before the current federal suit was filed. Whether the new lawsuit succeeds, and how the race ultimately ends, remains unknown.
